<p class=MsoNormal>Environmental reporter Bruce Henderson of <i>The Charlotte
Observer</i> told the audience at our Oct. 2 meeting that Charlotte’s
environment is blessed with a moderate climate, a gentle terrain, plenty of
water and recreation from the Catawba River, but we have not always treated
the environment kindly.<o:p></o:p></p>
<p class=MsoNormal><o:p> </o:p></p>
<p class=MsoNormal>He ticked off some of the unkind treatment to our
environment: raw sewage dumped into streams; some streams buried by
pavement; industrial air pollution; wetlands filled in; streams straightened
into ditches; and toxic chemicals dumped contaminating groundwater.<o:p></o:p></p>
<p class=MsoNormal><o:p> </o:p></p>
<p class=MsoNormal>Bruce said in the 1970s the Clean Water Act and Clean Air
Act helped turn things around, but imposed regulations that Charlotte still
struggles with. The Charlotte area has been growing fast and that makes it
harder to keep the environment clean.<o:p></o:p></p>
<p class=MsoNormal><o:p> </o:p></p>
<p class=MsoNormal>He said Mecklenburg County’s population nearly
double 1987-2007, but motor vehicle traffic increased nearly threefold. The
number of high ozone days has gone down from 36 in 1987 to 19 in 2007, but
the county will not be able to meet the federal ozone standard in 2010 and
the new standard will make it even hard.<o:p></o:p></p>
<p class=MsoNormal><o:p> </o:p></p>
<p class=MsoNormal>Fine particulates in the air are another rising concern, he
said. Air quality standards are getting harder to meet and possible federal
sanctions could stop road funding.<o:p></o:p></p>
<p class=MsoNormal><o:p> </o:p></p>
<p class=MsoNormal>Bruce said our lake water quality is good to excellent,
about the same as 20 years ago, and the amount of bacteria in the lakes
dropped 75%. However, he said 73 % of the major Mecklenburg streams are
impaired and that there are more than 1,100 contaminated groundwater sites in
the county, compared with 60 in 1987.<o:p></o:p></p>

<p class=MsoNormal>He warned that it is much more expensive to fix
environmental problems than it is to avoid them.<o:p></o:p></p>

<p class=MsoNormal><b>Fenton Erwin</b> was awarded the Evelyn M. Coman
lifetime distinguished service award given by the Construction Law Section of
the NC Bar Association. The award is given “to a person who has
committed a lifetime of work to construction law and has consistently upheld
the highest ideals of his profession; has made a noteworthy contribution in
the field of construction law; has a strong record of volunteerism and work
within the community; and possesses an exemplary professional record.” <o:p></o:p></p>
<p class=MsoNormal><o:p> </o:p></p>
<p class=MsoNormal>In announcing the award at the Annual Meeting of the
Construction Law Section at the Grove Park Inn in Asheville, the presenter,
after mentioning personal and family matters of interest, referred to the
large number of Supreme Court cases in which the position Fenton advocated
had been adopted by the Court and which established a precedent in
construction law; the statutes enacted by the legislature for which Fenton
was the principal draftsman; and his being NC Counsel for the American
Subcontractors Association for many years. Although established in 2002 there
have been only three other recipients<span style='color:#1F497D'> </span>of
the award<span style='color:#1F497D'>.<o:p></o:p></span></p>
